Privacy Policy for Personal Health Optimiser®

As the company which provides the personal health optimiser® member services via its www.healthoptimiser.com.au website, Lachesis Biosciences Pty Ltd (Lachesis®) is bound by Australian health records and privacy laws when handling personal information, which includes health or other sensitive information. These include:

the national Privacy Act 1988;
the National Privacy Principles (NPPs) contained in the Privacy Act;
the Victorian Health Records Act 2001;
the New South Wales Health Records and Information Privacy Act; and
the ACT Health Records (Privacy and Access) Act 1997.

What is personal information?

Personal information includes any information or opinion (whether true or not) about a person who can be identified from that information, which is recorded in some material form, including as part of a database. What personal information does Lachesis collect, from whom and why?

Lachesis will only collect personal information by fair and reasonable means.

When a person registers to become a personal health optimiser® member or uses its website, Lachesis will collect certain personal information from them. Lachesis will generally only collect personal information necessary to provide the personal health optimiser® membership services, benefits and products as described on its website from time to time. Generally, the kind of personal information collected includes:

personal contact details, including a nominated user name and password;
physical health measurements (such as weight, waist and height measurements, blood glucose levels and blood pressure);
mental health measurements (such as a basic needs satisfaction inventory and quality of life surveys);
member feedback on activities carried out and compliance with the health service programs;

Lachesis will not collect sensitive or health information from anyone unless they have consented or the collection is otherwise required or permitted by law. By using Lachesis' website or registering as a personal health optimiser® member, a person consents to the collection of such information.

What will the personal information be used for?

Lachesis will use the personal information it collects as follows:

to provide its customers with the personal health optimiser® membership services, benefits and products, including preparing personalised health reports and recommending activities to be undertaken, monitoring activities, compliance and feedback;
to send members the personal health optimiser® newsletter and updates from time to time about changes to the personal health optimiser®, membership services, benefits and products;
to administer payment for member services, benefits and products;
to compile aggregated data on a de-identified basis for the purposes of statistical research, data analysis and preparing reports in relation to health trends and other matters of general and research interest in the field of preventive healthcare;
for any other purpose which is disclosed at the time of collection of that personal information;
for related purposes (or directly related purposes if the information is health or sensitive information) that could reasonably be expected in the circumstances;
research as permitted by law;
if a person is applying for a position at Lachesis, to assess their application; or
where otherwise permitted or required by any other law.

Lachesis will only use health and sensitive information which it collects about a person with that person's consent unless otherwise permitted by law. By using Lachesis' website or registering as a personal health optimiser® member, a person consents to the uses and disclosure of their information as detailed here.

Lachesis will not be able to provide the personal health optimiser services unless all the information sought in the application form is provided.

To whom will Lachesis disclose the personal information it collects?

Lachesis will not disclose personal information it collects to any third party outside the company.

Lachesis may contact and communicate with its customers via this website, their email address, telephone, post, or SMS.

Generally, Lachesis will not direct market to anyone unless they have been given a prior opportunity to opt out of receiving future direct marketing communications.

Protection and management of personal information

Lachesis takes all reasonable steps to protect personal information it holds from misuse, loss or unauthorised access, modification or disclosure. It stores the personal information it collects on a secure and encrypted database which can only be accessed by the relevant member.

Lachesis will not generally delete health information save as permitted by law.

Complaints, access and correction

Lachesis will take all reasonable steps to ensure that the information it collects, holds or discloses about a person is accurate, complete and up to date.

Anyone can access the personal information Lachesis holds about them and, if they believe it is out of date, incomplete or incorrect, may request that it be updated or amended, save to the extent that is expressly provided by any privacy or other applicable laws.

If anyone believes that Lachesis has not dealt with their personal information in a manner that complies with the privacy laws, they should contact us so we can properly address and resolve their concerns.
